Terms of service

1. These Terms apply to all dealings between the Shop and its customers regarding the sale of products and other services provided through this Site (hereinafter "the Services").
2. The Shopping guide, the Legal notice (Specified Commercial Transactions Act) and the Privacy policy published on this Site, together with the descriptions and cautions on each product page, form part of these Terms. If these Terms differ from any of them, the individual provision takes precedence.
3. In these Terms, "made-to-order items, etc." means products that we make after receiving your order, such as custom figures and portrait illustrations (made-to-order items), and name-personalized items.

1. Please place your order following the procedure set out on this Site. You do not need to create an account.
2. A sales contract is formed when, after you complete the ordering procedure, the order confirmation email sent by the Shop reaches you.
3. If a minor places an order, please do so with the consent of a legal representative such as a parent or guardian.
4. In any of the following cases, the Shop may decline an order or cancel a contract that has already been formed. In that case, we will refund in full any amount you have already paid.
   • The information in the order was false, contained a serious error, or was incomplete
   • We cannot provide the product because it is out of stock, materials are hard to obtain, or similar reasons
   • It is reasonably judged that the order is for the purpose of resale
   • You have committed an act prohibited under Article 10

1. The selling price of each product is as shown on its product page. All displayed prices include consumption tax.
2. The shipping fee is a flat ¥800 per order, anywhere in Japan (tax included). Shipping is free when the total price of the products is ¥8,000 (tax included) or more (the gift wrapping fee is not counted in this total).
3. If you would like gift wrapping, we charge ¥330 (tax included) per order.
4. Bank transfer fees, and the internet connection and data charges for using this Site, are paid by you.

1. The payment methods and payment timing are as follows.
   • Credit card (VISA / Mastercard / JCB / AMEX): Payment is confirmed when you place your order.
2. If, for convenience-store or bank transfer payments, we cannot confirm your payment by the payment deadline, we will cancel the order.
3. Payments by credit card or PayPay are also subject to the terms of the relevant card company or payment provider.

1. Products are delivered by a carrier to the delivery address you specify. Delivery is limited to addresses within Japan.
2. Shipping times are as follows. After shipping, delivery usually takes 1 to 3 days (this varies by region).
   • Items in stock: shipped within 3 business days from the order date (from the day we confirm your payment, if you pay at a convenience store or by bank transfer).
   • Made-to-order items, etc.: shipped as soon as they are finished. Each product page gives an estimated production time.
3. Because of weather, traffic, the carrier's circumstances and other conditions, we may not always be able to deliver on the date and at the time you request.
4. If a product is returned to the Shop because of an incorrect delivery address, your absence or similar reasons, we will contact you and send it again. In that case, you may be asked to pay the shipping fee for sending it again.

1. Ownership of a product passes from the Shop to you at the time the product is handed over to you (meaning the time the carrier delivers it to your delivery address; the same applies below).
2. The risk of loss or damage to a product passes from the Shop to you at the time of handover. The Shop bears damage or loss that occurs before handover and will respond with an exchange or a refund in accordance with Article 9.

1. We make made-to-order items, etc. one at a time, within the time estimate given on each product page. If it may take longer than the estimate, for example when many orders come in at once, we will let you know in advance.
2. Because they are handmade, colors, shapes and patterns vary slightly from piece to piece. The colors in product photos may also look different from the real thing depending on your screen settings. These are not product defects, so please understand this in advance.
3. Photos and materials you send us for production must be ones you took yourself or ones you have the necessary rights to use. The Shop uses the photos and materials it receives only to make your piece and to contact you. If we want to use them for any other purpose, such as introducing our work or posting on social media, we will ask for your consent beforehand.
4. We make the piece based on the personalization text and the details you enter or specify when you order. Please check the spelling and the details carefully before you order.

1. For items in stock, we will accept changes or cancellations as long as we have not started preparing the order for shipment. Please contact us through the contact form as soon as possible.
2. We cannot accept changes or cancellations of made-to-order items, etc. once production has started. We start production promptly after your order is confirmed (after we confirm your payment, for convenience-store and bank transfer payments).
3. When a cancellation means we refund an amount you have already paid, we refund it by a method that corresponds to the payment method you used.

1. If a product is damaged or defective, or if you receive a product different from the one you ordered, please contact us within 7 days of receiving it. This includes made-to-order items, etc. We will respond with an exchange or a refund, and the Shop pays the return shipping. If you notice a defect later that could not be found when you checked on arrival, please also contact us promptly. We will look into the details and respond in good faith.
2. Returns or exchanges for the customer's own reasons are accepted only for items in stock that are unused and unopened, and only when you contact us within 7 days of receiving the product. The return shipping and the bank transfer fee for the refund are paid by you.
3. Made-to-order items, etc. cannot be returned or exchanged for the customer's own reasons.
4. Damage or soiling that occurs while the product is with you is not eligible for return or exchange.
5. The cooling-off system under the Act on Specified Commercial Transactions does not apply to mail-order sales. Whether a product can be returned, and on what conditions, is as set out in this Article.

The following acts are prohibited when using the Services.

• Acts that violate laws or public order and morals
• Acts connected with criminal activity
• Entering false information in orders or inquiries, or impersonating another person
• Purchasing products for the purpose of resale
• Acts that infringe the copyrights, trademarks or other intellectual property rights, portrait rights, privacy or reputation of the Shop or a third party
• Acts that place an excessive load on this Site's servers or network, or otherwise interfere with the operation of this Site, such as unauthorized access or attempts at it
• Acts that cause disadvantage or damage to the Shop, other customers or other third parties
• Acts equivalent to any of the preceding items

If you commit any of these acts, the Shop may decline your order or cancel the contract.

1. Copyrights, trademarks and other intellectual property rights in the text, photos, illustrations, logos, the character "Bele", product designs and so on published on this Site belong to the Shop or to third parties who rightfully hold them.
2. Purchasing a product does not mean any transfer of these rights or any license to use them. Beyond what the law allows, such as private use, you may not copy, republish, modify, sell or distribute them (including making or selling goods that use the illustrations, characters or product designs).
3. You are free to share photos of products you have purchased on your own social media or similar, as long as it is not for profit.
4. The copyright in works made as custom orders, such as portrait illustrations, belongs to the Shop. You may use the work freely for non-commercial purposes, such as your own social media profile picture and posts. If you would like to use it commercially, please consult us beforehand.

1. If delivery is delayed or the Services are interrupted for reasons not attributable to the Shop, such as natural disasters, epidemics or the circumstances of the carrier, the Shop is not responsible for any resulting damage.
2. Please use products according to the uses and cautions described on each product page. The Shop is not responsible for damage caused by use that differs from those descriptions, except where the Shop is at fault.
3. If you suffer damage for a reason attributable to the Shop, the Shop will compensate only the ordinary damage you directly and actually suffered, up to the price of that order (including shipping).
4. The limitation in the preceding paragraph does not apply where the damage is caused by the Shop's intent or gross negligence. Nothing in these Terms limits the rights granted to you by the Consumer Contract Act or other laws.

The Shop handles your personal information appropriately in accordance with the separately established Privacy policy.

1. The Shop may change these Terms, for example to reflect changes in the law or in the Services, in accordance with Article 548-4 of the Civil Code (changes to standard terms).
2. When we change these Terms, we will announce the new content and the date it takes effect on this Site in advance.
3. The revised Terms apply to orders placed on or after the effective date. Orders placed before that date remain subject to the Terms in force at the time of ordering.

1. These Terms are governed by and interpreted in accordance with the laws of Japan.
2. If a dispute arises between the Shop and you regarding the Services, we will discuss it in good faith and work toward a resolution.
3. If it cannot be resolved through discussion, the Maebashi District Court will have exclusive jurisdiction by agreement as the court of first instance.
